ADA: Legal Interview Questions

With the ADA, interviewers are concerned about the legality of some common interviewing questions. Follow these guideline to keep your interview questions legal.

Questions asked in any interview should (1) be job related, (2) have a positive intent and (3) be fair to all. However, the ADA does not require that every interviewer ask identical questions of each candidate.

If the candidate is compensating for an obvious physical disability (guide dog, wheelchair, etc.) one designated person on the interview schedule should discuss the implications of this on handling the essential functions of the job. However, every interviewer does not have to address the physical disability.
